"You might have thought that after the Home Secretary was accused of a ‘hate crime’, the Government would set about scrapping this ludicrous piece of legislation. Far from it. Amber Rudd fell foul of the law over her speech to last year’s Tory conference in Birmingham outlining plans to make companies disclose how many foreign workers they employ. Her innocuous remarks were enough for an Oxford professor to report her to West Midlands Police for inciting racial hatred, even though he hadn’t actually heard the speech.
That didn’t matter, since under Labour’s lazily drafted 2003 Criminal Justice Act, the definition of a hate crime is: ‘Any incident . . . which is perceived by the victim or any other person as being motivated by prejudice or hate.’ This gave licence to any politically motivated malcontent to bring hate crime charges, even though they themselves were not the alleged victim. In Rudd’s case, the Old Bill had no option other than to mount an investigation. They concluded that while the Home Secretary’s speech did not meet the burden of proof to warrant prosecution, it would still be recorded as a ‘non-crime hate incident’.
So that’s all right then. It wasn’t a crime, but it’s still regarded officially as ‘hate’. If the Home Secretary isn’t immune from this madness, then nobody is safe. Yet instead of restoring some semblance of sanity, the Government is pressing ahead with plans to create even more ‘victims’ — and by extension, more ‘hate criminals’."
